PROTECTION OF PERSONAL DATA POLICY – PPD

The new European Union regarding Data Protection regulation, GDPR (“General Data Protection Regulation”) entered into force on May 25th, 2016, but will begin to take effect as of May 25th, 2018. This law represents the biggest change in personal data protection over the last 20 years, and has objectives that go far beyond just protecting private space.

Your personal data protection is important to us, therefore we pay special attention to protecting the privacy of those visiting www.izoterma.ro website, as well as those whose personal data are provided to us by a third party, or to which we have access from another source in accordance with European Parliament and Council 2016/679 27 Regulation (EU), from April, 27th, 2016 on the protection of individuals in regards to the processing of personal data and the free movement of such data (hereinafter referred to as “GDPR”).

Please take your time to carefully read this Policy (hereinafter referred to as “PPD”) in order to better understand the way your information will be treated (“personal data”).

PPD explains IZOTERMA CONSTRUCT practices regarding the application of the GDPR provisions, as well as the rights you benefit from in regards to how your information is processed by IZOTERMA CONSTRUCT.

The processing of personal data by IZOTERMA CONSTRUCT will always be done in accordance with the GDPR provisions, as well as with the personal data protection regulations specific to each country in which IZOTERMA CONSTRUCT operates.

Through the means of PPD, IZOTERMA CONSTRUCT wishes to inform subjects about the nature of the personal data that we collect and process, as well as about the purposes of the processing. In addition, the subjects are informed about their rights via PPD.

We are IZOTERMA CONSTRUCT S.R.L., a company with headquarters in Curtea de Arges, Busaga Str., 6, with serial number in the Trade Register J03/2371/2008 and unique registration number RO24778000. We have as main field of activity painting and glazing works, CAEN code 4334 and our legal representatives are the administrators Iulian Serban and Alexandru Turcu.

IZOTERMA CONSTRUCT S.R.L. as an operator, has appointed Mrs. / Mr.Clarina Gasca, as Data Protection Officer (hereinafter referred to as “DPO”), having the obligation to verify compliance with GDPR provisions in data processing operations performed by the operator and to represent the operator in the relationship with subjects and with the Supervisory Authority.

WHAT ARE THE PERSONAL DATA?

“Personal data” means any piece of information or information which can identify you directly (for example, your name) or indirectly (for example, through the pseudonyms data, such as an unique identification number). This means that personal data include things such as e-mail address, home address, personal preferences and buying customs, content generated by users, financial information as well as information related to financial situation. It could also include unique numeric identifiers, such as the IP address of your computer or the MAC address of your mobile device, as well as cookie modules.

WHAT DOES PROCESSING PERSONAL DATA MEAN?

“Processing” means any operations or set of operations performed on personal data or on sets of personal data, with or without using automatized means such as collecting, recording, organizing, structuring, storing, adapting or modifying, extraction, consulting, using, disclosure by transmission, dissemination or otherwise making available, aligning or combining, restricting, deleting or destroying.

Your personal data which are to be processed are the following: first name, last name, telephone number and e-mail address, as well as the data included in your resumes you send to us.

DATA PROCESSING PRINCIPLES

IZOTERMA CONSTRUCT S.R.L. undertakes to respect the personal data protection principles (hereinafter named “Principles”) stated by GDPR, as to assure that all data are:

  1. Correctly, legally and transparently processed;
  1. Collected for specified, explicit and legitimate purposes;
  1. Adequate, relevant and limited in relation to the purposes for which they are processed;
  1. Correct and updated;
  1. Retained in a form which makes it impossible to identify the data subjects longer than necessary in relation to the purpose of the processing;
  1. Processed in accordance with the rights of the data subject, in a manner that ensures adequate processing security so that data is complete, confidential and available.

BASIS AND PUROPSES OF PERSONAL DATA PROCESSING

  1. For the purpose of concluding and executing contracts – According to art. 6 par. 1 lit. b) from GDPR, personal data may be processed for the purpose of concluding or executing the contract. In order for us to be able to offer you our products, we need to process personal data that you own.
  1. For the purpose of fulfilling legal obligations – According to art. 6 par. 1 lit. c) GDPR personal data my be processed for the purpose of fulfilling legal obligations. We request a series of personal data, including, in some cases, the personal numeric code, in order to fulfill our tax authorities’ obligations regarding invoicing and reporting to tax authorities.

RECRUITING

If you apply for a position within IZOTERMA CONSTRUCT, published in the specific section of this site, the Curriculum Vitae (CV) that belongs to you or other information you provide to us will only be used to process your request and to manage the recruitment process. Following the voluntary submission of the Curriculum Vitae document through IZOTERMA CONSTRUCT website, IZOTERMA CONSTRUCT does not verify the accuracy of the content, will not automatically accept the application, will not automatically make a job offer.

The Curriculum Vitae document you send will only be used to select candidates. We will not distribute, rent or voluntary sell your personal data outside IZOTERMA CONSTRUCT, except for the case when we are obliged to share your information to third parties which offer services on our behalf.

DATA PROCESSING

DATA STORAGE PERIOD

IZOTERMA CONSTRUCT can store processed data for different time periods, appreciated as being reasonable, in accordance with the purposes previously indicated. We store your personal data only for the needed period in order to achieve the goals for which we hold the data, in order to satisfy your needs or for us to achieve the obligations imposed by law.

To know how long your data can be stored, we use the following criteria:

  1. If you have given your consent to recruitment, we retain your personal data until you ask us to delete it. In this regard, please note that the data stored in our databases for recruitment purposes is deleted from the records of these databases 5 years after lour last interaction with you;
  1. In case you contact us with a question, we retain your personal data during the needed time to process your questions, but no longer than 5 years from your last correspondance with us;
  1. In case the cookies are stored on the computer, we keep these as long as necessary for these to achieve their purposes (for example, during a cookie session for shopping bag or cookies for session IDs) and for a certain period, in accordance with local regulations. Thus, we mention that personal data processed through cookies in order to provide online advertising behaviour, to personalize services for you and to allow the distribution of our content on socializing websites (distribution buttons designed to show the website) will be retained for a maximum period of 5 years from the moment these were collected, based on your consent.

TARGETED PERSONS’ RIGHTS

In accordance with GDPR, you have a series of rights in respect to your personal data which IZOTERMA CONSTRUCT processes:

  1. Right to access your processed rights – You have the right to access your personal data we hold. The first time we provide these we don’t perceive any tax. If you need copies of the information already provided, we might charge you a reasonable tax, considering the administrative costs of providing information. Unreasonable, excessive or repeated requests may not be answered.
  1. Right to amend your rights – You have the right to ask for your data to be amended if not exact or not updated and / or add something if these are incomplete.

  1. Right to restrict the processing – You have the right to request restriction your data processing. This means that your data processing is limited, so as to retain your data but not use or process them. This right applies in specific circumstances, speficied by the general date protection Regulation, namely:

– the accuracy of the Data is contested by the subject (ie you) for a period that allows the operator (ie IZOTERMA CONSTRUCT) to verify the accuracy of the Data;

– processing is illegal and the subject (ie you) is against the deletion of the Data and requires restriction in using these;

– operator (for example, IZOTERMA CONSTRUCT) no longer needs the Date to process, but these are required by the subject (ie you) in order to establish, exercise or defense of legal claims;

Depending on the context, we may find ourselves in the situation of the absolute need to provide information at a higher level, both globally and internally or externally, to our partners and to those with whom we transfer GDPR data in the virtue of providing the most professional services possible. These data transfers are necessary to deliver the highest level of service and to continue to provide you with our best professional content.
